Supportive Measures

Supportive measures are individualized, non-punitive services to restore or preserve equal access to education, protect student and employee safety, or deter sexual harassment. Supportive measures are available to both Complainants and Respondents and must be offered even if a complainant does not wish to initiate or participate in a grievance process or if a formal complaint is later dismissed under the mandatory or discretionary dismissal procedures.
Key aspects of Title IX supportive measures in K-12:

1. Individualized approach and at no cost to the student:
Supportive measures should be tailored to the specific needs of each student and their situation.
Supportive measures should be provided at no additional cost to the student.

2. Accessible and confidential:
Schools must ensure that support services are readily available and confidential, allowing students to report incidents without fear of retaliation.

3. Examples of Title IX supportive measures in K-12:
Counseling services: Access to individual or group therapy to help students cope with the trauma of the incident.
Class schedule adjustments: Changing class schedules to minimize contact with the alleged perpetrator. Remember, class changes cannot be punitive.
No-contact orders: Implementing mutual restrictions that prevent the alleged perpetrator from contacting the victim and vice versa.
Escort services: Providing safe escorts to and from classes or other school activities.
Academic accommodations: Offering extensions on assignments or alternative assessment options if needed.
Communication with parents/guardians: Keeping parents informed about the situation and support options available.
Staff training: Ensuring all school staff, including teachers, administrators, and counselors, are trained on Title IX regulations and how to appropriately respond to allegations of sex-based harassment.
All supportive measures implemented at the school level must be reported to the Title IX Coordinator for recordkeeping purposes. Supportive Measures remain in place until rescinded by the Title IX Coordinator.
